CONTRACT TERMS AND CONDITIONS OF USE MONICA WIFI
VERSION 11 - ENGLISH
Signed between, on the one hand, 有限会社 メガシステム Yugengaisha MegaSystem Co., Ltd., a company based in Tokyo - Head Office: 〒163-1030 Tokyo-to Shinjuku- ku Nishi-Shinjuku 3-7-1 Shinjuku Park Tower N30F, here by represented in accordance with her trade name ("NewSky"); and, on the other hand, the costumer, already qualified in the Registration Form ("Costumer", when referred together with NewSky, "Parts" and, separately, "Part") WHERE AS: NewSky offers the possibility for the customer to contract services and benefits through a monthly subscription; SERVICES OR SPECIFIC BENEFIT BY SUBSCRIPTION (“Term”), which will be governed in accordance with the following terms and conditions:
1. The purpose of this Term is to regulate the conditions applicable to the contracting, use and cancellation of services and benefits offered by NewSky specific services (“Services”) through a monthly subscription. Please, read carefully the Term and all the conditions listed below. By not fully or partially agreeing with this Term, as well as with any additions, changes or updates, the Customer will not be able to access the Services.
3. TYPES OF CONTRACT, PLANS & MONTHLY VALUES.

*For plans with data cap, after consuming all your data cap, the speed will be reduced for a short period, and then it may stop working, returning to normal next month.
*◎UNLIMITED for personal use (one device at a time) and fair use; 4 Mbps maximum speed for watching videos between 720p~1080p; not recommended for downloading frequently;
*We advise that the uninterrupted use with a frequency above 10 GB per day in the plan with monthly franchise and 5 GB per day in the UNLIMITED plan for personal use, could cause speed reduction, signal cut-off without prior notice and even cancellation of the contract by request from the operator or Japanese government.
◎IF ANY "CAMPAIGN WITH FREE TABLET OR TABLET WITH DISCOUNT CAMPAIGN"
The campaign is valid for as long as the stock lasts and can be ended at any time without notice.
◎CAMPAIGN VALID ONLY FOR CONTRACT WITH UNLIMITED PLAN.
◎ The discount benefit or promotion of the free device will be only who makes the 12-month contract and fulfills the minimum of 12 months of monthly payments. If there is a cancellation before this deadline, the device must be paid in full, according to the amount described in the invoice / order, in addition to the amounts of the fines, termination of contract and other fees. CONSULT YOUR INVOICE TO KNOW ABOUT THE ROUTER MODEL, IF IT IS PURCHASED OR RENTED AND VALUES.
The MONICA WIFI ROUTER is rented and must be returned at the end of the contract. The device is already configured, ready for use and any changes or adjustments to the device settings are prohibited.

PREMIUM KIT: ENERGY CHARGER, USB CABLE and EXCLUSIVE NEWSKY POCKET. The customer is allowed to enjoy the premium kit as long as he is an active subscriber to the service. The Premium Kit is loaned and must be returned at the end of the contract.

LOSSES AND DAMAGES OF MONICA WIFI ROUTER:
Loss or damage to device: ¥12,000, for active contracts, in use.
Loss or damage to the PREMIUM KIT: ¥ 3,000.
In case of loss of your device, you can buy another one or rent one. In this case, the prices will be those offered at the moment. Consult us!
Loss of MONICA WIFI ROUTER: It will be considered 'loss' when the damage to the device makes it impossible to use, interfere with important functions, if the device is aesthetically marked with marks that de-characterize the product, if it is not returned or is lost.
Damage of MONICA WIFI ROUTER: It will be considered 'damage' when the device has a mark that is only light in appearance, does not de-characterize the product, and does not prevent normal use.
This analysis will be made exclusively by NewSky or a responsible person chosen by NewSky, and any type of analysis by third parties will not be accepted without proper authorization.
The MONICA WIFI ROUTER must be returned no later than the 5th of the month that you do not wish to use the service, with a daily fine of ¥ 500 for delay in returning from the 6th.
The non-return of the equipment MONICA WIFI ROUTER at the end of the contract: There is a fine of ¥ 25,000 + other taxes applies.
Non-return of the device MONICA WIFI ROUTER and, or non-payment of the monthly fee until the date of the 20th will be considered abandonment of contract.
If you count Internet usage in the month that you do not want to use the service, the full monthly fee must be paid. No exception.

For charging through the Smart Pit, once the charge has been launched, if there is a need to launch a new charge or change the payment date, there will be a fee of ¥ 1,000 added to the amount of the fine.
General documents and information will be used for resolution by legal means and, in addition, your name may also be registered with the CREDIT PROTECTION SERVICE in Japan and abroad. Any legal issues will be resolved with the Tokyo Court of Justice.
8. CONTRACT, DATA TRAFFIC & SUSPENSION RIGHTS.
A. We inform that as of January 2016, Japanese data traffic control laws have become stricter. New rules from operators or the government may occur without notice. Restrictions on the volume of data traffic may apply.
B. We provide adequate data capacity for general use, but from the point of view of fair use and maintaining the quality of the network, the usage restriction can be applied to users who communicate in large quantities, download large files, very long videos, etc. In these cases, measures can be taken, such as interrupting communication or greatly reducing the speed of communication.
C. Customers who consume large amounts of data need to be aware. * Will not be refunded or exchanged, etc. if suspension measures or speed restrictions are applied by the operator or the government. NewSky is not responsible for signal failures in some areas.

E. In case of delay or abandonment of a service contract, if the customer has another active service, NewSky reserves the right to be able to suspend the other service without prior notice.
F. NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it brings losses to the company or in case the company deems the customer's misuse or misconduct, without prior notice and without refund.
G. We recommend that you do not make changes to the router's settings, the device is already configured and ready to use.
H. In case of suspension of the service due to accidents or unscheduled maintenance, there will be no refund for the time the service is unavailable.
I. NewSky reserves the right, in the event of any change in the service by the operator, to pass this change on to the customer without prior notice, in compliance with the rules thus required, including price adjustments.
J. The maximum communication speed of the device and service are maximum values based on technical standards and do not necessarily represent speeds in actual use. Internet speeds during use may vary due to the user's environment (such as terminal device specifications) and network congestion.
K. The collection of pendencies or debts can also be done abroad. The customer may have the name included in the SPC (credit protection service).
L. You will be charged 14.5% interest per year on unpaid amounts and outstanding amounts with NewSky, be it late fees, cancellation penalty, or any other outstanding that the customer may have with NewSky.

B. Service for technical support or issues regarding late payment will only be resolved within the office hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on weekends and national holidays).
