CONTRACT TERMS AND CONDITIONS OF USE
CHIP NEWSKY MOBILE (INTERNET) - DOCOMO (1GB / 3GB / 5GB / 10GB / 30GB / 50GB)

a) SIM card with (1GB; 3GB; 5GB; 10GB; 30GB or 50GB), with DOCOMO area coverage available where there is 4G / 3G. We are not responsible for signal failure in certain areas.
b) Newsky Mobile is indicated for the use of applications such as WhatsApp, Facebook, Messenger, Skype among others. And also make and receive calls using the phone number 050 NTT with UNLIMITED calls.

2.1. PLAN CHANGE
a) You can increase or decrease the amount of GB within your plan. To do this, you must request between 01 and 05, to have it changed in the following month, a fee of ¥2,000.
b) It is not possible to change a DATA plan to DATA + SMS or vice versa. In this case, a new contract must be made.
3. IMPORTANT INFORMATION:
a) The customer must own or purchase an UNLOCKED SMARTPHONE or TABLET device (or DOCOMO, without pending issues) with a 3G / 4G system.
b) There is no limit on the daily use of the internet, after reaching the contracted GB limit, the speed will be reduced, maximum of 128 Kbps by the end of the month. The plan is described on your invoice; Normal speed will return on the first day of the month.
c) No changes (cutting, forced adaptation, etc.) in the SIM CARD format are allowed.
d) The receipt of messages via SMS is unlimited and free.
d) NewSky offers free shipping of up to 50 SMS messages within Japan only (domestic shipping). After this amount, you have a cost per message sent of ¥30 within Japan and ¥200 International; Be cautious when sending messages via SMS, as there will be a cost if you exceed the quota. We recommend using apps like WhatsApp, Messenger, Skype, etc .
f) In case of suspension of the service due to accidents, unscheduled maintenance, emergency or force majeure, there will be no refund for the time the service is unavailable.
g) NewSky reserves the right to pass on to the customer any changes requested by the operator without prior notice, including price adjustments.
h) The speed can vary significantly according to periods of the day, network congestion and according to the user's environment (such as the specifications of the terminal device), reaching a maximum of 1 Mbps.
i) The maximum communication speed shown here, indicates maximum values based on technical standards and does not necessarily represent speeds in actual use. Internet speeds during use can vary significantly due to the user's environment (such as the specifications of the terminal device) and network congestion.

c) A Smart Pit card will be sent with the service request (router or SIM CARD) to be used for payment at convenience stores (Kombini: Family Mart, Mini Stop and Lawson).
d) There is not billet, monthly payment must be made by Smart Pit card or Credit Card.
e) Payment must be made every month using the same Smart pit card. In case of loss, payment can be made using only the number (the customer must request it through our call center or virtual channels). If you need a new card, you will have a replacement fee of ¥2,000;
f) Payment due date: DAY 20 OF EACH MONTH, with MAXIMUM TERM until the 25th of the same month (payment cards are activated every month from the 15th)
g) If payment is not made within the maximum period, the SIM Card will be automatically canceled at 23:59 on the last day of the month, and there will be no possibility of reactivation. To use the service again you will need to sign up for a new contract.
h) Collection fee (Kombini / CREDIT CARD) of ¥200 might be charged at any time by NewSky, without prior notice, to correct amounts. So far, this fee is being paid by NewSky.
i) If you have abandoned your contract, but made payment for a month for which you have not used any day, NewSky reserves the right to confiscate the amount paid to guarantee payment of any amount pending with the company, for example: cancellation penalty, no return of router or SIM Card, thus reducing the total or partial amount of the pending item. This confiscation does not result in an immediate resolution of the customer's pending issue, but rather a compensation for the losses caused to the company.
j) To request change the payment method: via Smart pit card via credit card or vice versa, the customer must contact our call center, with minimum of 30 days in advance.
l) Will be discounted via credit card (registered), fine for terminating the contract, any extra fees or other pending issues related to the service contracted with NewSky.

b) Documents required for the contract: copy of the ZAIRYU CARD front and backsides the updated address; driver's license or passport.

d) In case of change of address or telephone, the customer must inform NewSky immediately, the registration must always be updated.
d) NewSky communicates with customers through SMS, Facebook, WhatsApp, e-mail or telephone.
f) The SIM card is not transferable. If the customer transfers the SIM CARD to third parties, it may suffer legal consequences.
g) If you close the contract with NewSky and leave pending issues, Ex: non-payment by sending SMS, and do not take care of the resolution through immediate payment of the amounts, the client documents and general information will be sent to the Libra Legal Law Firm Office, being from that moment responsible for the case; in addition, your name may be registered with the Japan CREDIT PROTECTION SERVICE.
6. LOSS OR THEFT
a) In the event of loss or theft, the customer must report to NewSky immediately.
b) In the event of loss of the device with a telephone number provided by NewSky, the customer must immediately issue a BULLETIN and send to NewSky. * This process is mandatory in case of loss or theft of a SIM CARD cell phone with a telephone number.
c) There will be a fee of ¥3,300 + shipping, if any, to enable a new SIM CARD. The replacement will be made within 7 working days.
a) The SIM card is prepaid, and the contract is monthly and can be terminated at any time by the customer.
b) To cancel, do not pay the next invoice and return the SIM card (the SIM is loaned at no additional cost when using the service).
c) To request cancellation of the service using a credit card payment method, the customer must contact our call center, with minimum of 30 days in advance.
d) Upon terminating the contract, the SIM Card must be returned to NewSky by the 5th of the month after the last month paid.
e) If the customer has used the excess SMS, the fee will be charged later (up to 90 days after use) and must be paid through the Smart Pit Card (during the contract or after cancellation).
8. RIGHT OF SUSPENSION
a) If you have financial issues with NewSky, it reserves the right to suspend any additional services on behalf of the holder until the issues are resolved.
b) NewSky reserves the right to suspend or unilaterally cancel the customer's contract, if it brings losses to the company or if the company deems the customer to be misusing or misconducting, without prior notice and without compensation.
9. DATA TRAFFIC

a) NewSky does not provide support and is not responsible for software and applications used by the customer.
b) NewSky Mobile uses the NTT DOCOMO network, but all support is exclusively offered by NewSky, where DOCOMO disclaims liability.
c) Technical support for the use of the 050 NTT application will be provided by NewSky.
d) Service for technical support or issues regarding late payment will only be resolved within the office hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on national holidays).
