CONTRACT TERMS AND CONDITIONS OF USE

COMBO (INTERNET SIM CARD + 050) - VERSION 7.1 - ENGLISH

 

1.SERVICE

PRE-PAID PLAN COMBO: Internet CHIP + 050 NTT unlimited calls

a) 050 NTT unlimited calls:

  • 050 NTT application (IP Phone) with phone number to make and receive UNLIMITED (domestic) calls. Service provided by NTT Communications.
  • What is 050 (IP Phone) application?
  • An IP phone is a telephone service that uses the internet to make a call using a telephone number.
  • The call rate is fixed and is indicated for general use, as first line or secondary line.
  • Keep the same phone number even when changing devices.
  • It is also possible to make and receive calls to phones in Japan, even when you are abroad.
  • Easy to use, just download the app (application), enter credentials and you're done!

b) Internet CHIP:

  • A very high quality system for better portability, communication and satisfaction.
  • MONICA CHIP LITE and PRO: Softbank area coverage available where there is 4G / 3G.
  • NEWSKY MOBILE DOCOMO CHIP: DOCOMO area coverage available where there is 4G / 3G.
  • SIM CARD is indicated for personal use (except torrent; p2p or similar), and MUST BE RETURNED AT THE END OF THE CONTRACT.

1.1. OPTIONS

Unlimited calls (050) + Internet SIM card with data plans of 1GB, 3GB, 5GB, 10GB, 30GB or 50GB + SMS

1.2. OPTIONS

1.3. IMPORTANT INFORMATION:

a) The customer must own or purchase an SMARTPHONE UNLOCKED device with 3G / 4G system.

b) No alteration (cutting, forced adaptation, among others) in the internet SIM CARD format is allowed, it will be considered as damage to the SIM card.

c) The optional voicemail must be requested at the time of order, a one-time fee of ¥1,100, may be requested later but there will be a change in the fee. To take advantage of voicemail, you must enter a VALID email address to receive missed call notifications. To order later, you should contact the Newsky call center, a one-time fee of ¥3,240.

d) The plan has a system of unlimited and free calls to cell phones or homes, for all operators in Japanese territory. There are some exceptions, as it is not possible to call some numbers with IP phones:

*Emergency call (110/119)

*Toll-free number (some numbers can be dialed)

*Three-digit number service (104/115, etc.)

*Calls to numbers starting with 0990, 0570 etc.

e) IP phone consumption data capacity:

About 500 KB is required for a one-minute call.

When converted to 1 hour, it is about 30 MB and, if you call 1 hour every day, it is estimated to consume around 900 MB per month.

f) Required communication speed: minimum 128 kbps.

g) The registration of the activation may take up to two business days to release the service.

h) In case of suspension of the service due to accidents or unscheduled maintenance, there will be no reimbursement for the service downtime;

i) NewSky reserves the right, in the event of any change in the service by the operator, to transfer the change in the service provided to the customer without prior notice, in compliance with the rules thus required, including price adjustments.

j) The maximum communication speed shown here, indicates maximum values ​​based on technical standards and does not necessarily represent speeds in actual use. Internet speeds during use can vary significantly due to the user's environment (such as the specifications of the terminal device) and network congestion.

l) Minimum use of 050 NTT: 2 months.

1.3.1. COMBO MONICA LITE - IMPORTANT INFORMATION:

a) There is no limit on the daily use of the internet and after reaching the limit of the contracted GB the speed will be reduced, maximum of 128 Kbps by the end of the month. The plan is described on your invoice. Normal speed will return on the first day of the month;

1.3.2. COMBO MONICA PRO - IMPORTANT INFORMATION:

a) On the 100GB Chip when reaching 100GB, the signal may be cut or there will be a speed reduction and will return automatically at the beginning of next month, if the invoice is paid.

b) In the UNLIMITED Chip will be subject to verification of fair use by the operator after exceeding 250GB and may be temporarily interrupted or there will be a speed reduction and will return automatically at the beginning of next month, if the invoice is paid.

c) There is no limit on daily use, but uninterrupted use with a frequency above 10GB may cause a speed reduction, signal cut without notice and even the cancellation of the contract at the request of the operator or the Japanese government.

1.3.3. COMBO DOCOMO and COMBO DOCOMO SMS - IMPORTANT INFORMATION:

a) There is no limit on the daily use of the internet, after reaching the contracted GB limit the speed will be reduced, maximum of 128 Kbps by the end of the month. The plan is described on your invoice; Normal speed will return on the first day of the month;

b) The receipt of messages via SMS is unlimited and free.

1.3.4. COMBO DOCOMO SMS - IMPORTANT INFORMATION:

a) NewSky offers the free sending of up to 50 SMS messages only within Japan (domestic delivery). After this amount, there is a cost per message sent from ¥30 within Japan and ¥200 internationally; Be cautious when sending messages via SMS, as there will be a cost if you exceed the quota. We recommend using apps like WhatsApp, Messenger, Skype, etc.

c) A Smart Pit card will be sent with the service request (router or SIM CARD) to be used for payment at convenience stores (Konbini: Family Mart, Mini Stop and Lawson).

d) There is no billet, monthly payment must be made by Smart Pit card or Credit Card.
e) Payment must be made every month using the same Smart pit card. In case of loss, payment can be made using only the number (the customer must request it through our call center or virtual channels). If you need a new card, you will have a replacement fee of ¥2,000.
f) Payment due date: from the 15th to the 25th of each month (payment cards are activated every month from the 15th)

g) Collection fee (Konbini / CREDIT CARD) of ¥200, may be charged at any time by NewSky, without prior notice, to correct amounts. So far, this fee is being paid by NewSky.
h) To change the payment method: via Smart pit card via credit card or vice versa, the customer must contact our call center, with minimum of 30 days in advance.
i) Will be discounted via credit card (registered), fine for terminating the contract, any extra fees or other pending issues related to the service contracted with NewSky.


2.1. COMBO MONICA LITE, COMBO DOCOMO and COMBO DOCOMO SMS - PAYMENT

a) If payment is not made by the deadline (until the 25th of the month), the internet SIM Card and the 050 NTT SERVICE will be automatically canceled at 23:59 on the last day of the month, and there is no possibility of reactivation. To use the service again, you will need to sign up for a new contract. Once canceled, it will not be possible to recover the number (the number will be lost in the event of cancellation and there will be no way to reuse it).

2.2. COMBO MONICA PRO - PAYMENT

a) Payment must be made on time and processed by our exchange so that there is no cut-off. Payment after the 25th is already overdue, and from the 26th onwards it already has a fee of ¥2,000 in the monthly fee for late or reactivation penalty (without exception). If the payment is not confirmed by the deadline, when the month is over, the deposit will be suspended immediately, and will be abandoned after the 5th, and the contract will be canceled after the 5th. The maximum period for the payment of the delayed monthly payment is until the 5th of the following month, with a late fee. Payment after the 5th will only be accepted through prior negotiation with NewSky;
b) If cut due to non-payment, the signal will be reactivated within 3 BUSINESS DAYS after confirmation of payment;
c) If you have abandoned your contract, but have made payment for a month for which you have not used any day, NewSky reserves the right to confiscate the amount paid to guarantee payment of any amount pending with the company, for example: cancellation penalty, no return of router or SIM Card, thus reducing the total or partial amount of the pending item. This confiscation does not result in an immediate resolution of the customer's pending issue, but rather a compensation for the losses caused to the company.

4. CONTRACT

a) Documents required for the contract: copy of the ZAIRYU CARD VALID front and back with the updated address; copy of PASSPORT (pages 1, 2 and 3) or driver's license.

b) Necessary information of the client (inform at the time of order): full name, full address, e-mail, telephone number (if not, it will be necessary to inform the telephone number of a contact, relative or friend)
c) In case of change of address or telephone, the customer must inform NewSky immediately, the registration must always be updated.
d) NewSky communicates with customers through SMS, Facebook, WhatsApp, e-mail or telephone.

e) The internet SIM card is not transferable. If the customer transfers the SIM CARD to third parties, it may suffer legal consequences.

4.1. COMBO MONICA LITE, COMBO DOCOMO and COMBO DOCOMO SMS - CONTRACT

a)Contract MONTHLY, without penalty when canceling (total freedom to cancel whenever you wish).

4.2. COMBO MONICA PRO - CONTRATO

a) There are 2 types of contract: MONTHLY and ANNUAL. The customer must inform the attendant of the option when ordering.
b) If there is any promotion or free monthly fee, the bonus month of the promotion will NOT be counted within 12 months of the contract. The customer must pay every month of the contract, regardless of promotion. Example: If the contract is for 12 months with a free 1 month promotion, the customer MUST pay the 12 monthly payments (instead of 11), as the promotion will not enter this period.

5. LOSS OR THEFT

a) In the event of loss or theft, the customer must notify NewSky immediately;

b) COMBO MONICA LITE: There will be a fee of ¥3,300 + shipping, if any, to enable a new SIM CARD. The replacement will be made within 7 working days;

c) COMBO MONICA PRO: There will be a fee of ¥5,000 + shipping, if any, to enable a new SIM CARD. The replacement will be carried out from 7 to 15 working days.

d) COMBO DOCOMO and COMBO DOCOMO SMS: There will be a fee of ¥3,300 + shipping, if any, to enable a new SIM CARD. The replacement will be made within 7 working days. In the event of loss of the device with a telephone number provided by NewSky, the customer must immediately issue a BULLETIN and send it to NewSky. *This process is mandatory in case of loss or theft of a SIM CARD cell phone with a telephone number.

6. COMBO MONICA LITE, COMBO DOCOMO and COMBO DOCOMO SMS - CANCELLATION

a) The service is prepaid, the contract is monthly and can be closed at any time by the customer.

b) There is no penalty (without cancellation fee).

c) To cancel, do not pay the following invoice and return the SIM card from the internet (the SIM is borrowed at no additional cost when using the service), the service will automatically be canceled, making it impossible to use the SERVICE / internet SIM card after the last day of the month paid.

d) To request cancellation of the service using a credit card payment method, the customer must contact our call center, with minimum of 30 days in advance.
e) Upon terminating the contract, the internet SIM Card must be returned to NewSky by the 5th of the month after the last month paid.

6.1. COMBO MONICA PRO - CANCELLATION

a) Cancellation of the MONTHLY or ANNUAL plan:

Step 1: The customer must return the SIM card to NewSky through the return KIT or by convenient means until the 5th of the month after the due month;

Step 2: The customer must pay the amounts due to NewSky;

b) MONTHLY plan cancellation: to cancel, the customer simply does not pay the next monthly fee and sends the SIM card to NewSky;

c) To request cancellation of the service using a credit card payment method, the customer must contact our call center, with minimum of 30 days in advance.
d) ANNUAL plan cancellation: The minimum contract is 12 months. To cancel, the customer must contact Newsky. Cancellation within 12 months or later, the SIM card must be returned to NewSky;

e) After the 5th of the month after the last month paid, if you DO NOT pay or DO NOT return, the SIM card and the contract will be canceled, understood as ABANDONMENT by the CLIENT, according to this contract;

f) Failure to return the SIM card until the 5th (of the month after the last month paid), and the lack of interest or lack of communication with NewSky, in addition to a daily fine, fines referring to clauses not complied with by the client, which will be charged by our legal representative, the Libra Legal Office, being from that moment responsible for the case and, according to the case, a case will be opened in the court of law in the jurisdiction of Tokyo; The documents and general information will be used for resolution by legal means and, in addition, your name may also be registered with the Japan CREDIT PROTECTION SERVICE.


7. COMBO MONICA PRO - VALUES OF FINES (CONTRACT, LOSS AND DAMAGE)

The daily penalty will only stop counting when the customer returns the SIM card and negotiates with Newsky.

ABANDONMENT of contract

¥20,000  

With the non-return of the SIM card, after the 5th the contract will be given as ABANDONMENT, and will be charged with: “cancellation penalty (in the case of annual contracts) + penalty for non-return of the SIM card + daily fine + abandonment fine ”.

* After the loss or theft where the customer no longer wishes to use the service, the customer must pay the fine for not returning the SIM CARD + the fine for canceling the contract (if he has not fulfilled the months of the contract).

* In the above cases the payment of the fine must be made through the Smart Pit. The customer must inform the date and time that he will make the payment. If there are changes once a charge is activated, it will add ¥1,000 to activate a new charge.

8. RIGHT OF SUSPENSION
a) In case of delay or abandonment of a service contract, if the customer has another active service, NewSky reserves the right to be able to suspend the other service without prior notice.

b) NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it brings losses to the company or in case the company deems the customer's misuse or misconduct, without prior notice and without compensation.

c) The unlimited calling service is intended for commercial or personal use, however the use of several consecutive hours may cause the service to be suspended.

9. DATA TRAFFIC

a) Restrictions on the volume of data traffic may apply. We provide adequate data capacity for general use, but from the point of view of maintaining network quality and fair use of the network, the communication restriction can be applied to users who communicate in large quantities, download large files, very long, etc. In these cases, measures can be taken, such as interrupting communication or greatly reducing the speed of communication. Customers who consume large amounts of data need to pay attention to this, as per the information above. *Will not be refunded or exchanged, etc. if suspension measures or speed restrictions are applied by the operator or the government.

c) NewSky is not responsible for signal failures in some areas;

10. SUPPORT and CONTACT

a) NewSky does not provide support and is not responsible for software and applications used by the customer;

b) Technical support for the use of the 050 NTT will be provided by NewSky.

*On the Android system, the 050 app must always be running (open) in order to receive calls.

Depending on the problem, technical support may take up to 3 business days to respond.

c) Service for technical support or issues regarding late payment will only be resolved within the office hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on national holidays).
