WHEREAS: NewSky offers the possibility for the customer to contract services and benefits through a monthly subscription; the parts RESOLVE to enter into this TERMS OF CONTRACTING SERVICES OR SPECIFIC BENEFIT BY SIGNATURE (“Term”), which will be governed in accordance with the following terms and conditions:

1. The purpose of this Term is to regulate the conditions applicable to the contracting, use and cancellation of specific services and benefits offered by NewSky (“Services”) through a monthly subscription. Please read carefully the Term and all the conditions listed below. By not fully or partially agreeing with this Term, as well as with any additions, changes or updates, the Customer will not be able to access the Services.

2.SERVICE

    A. SIM CARD telephone line with internet and SMS, with coverage of available areas where there is 3G / 4G from Docomo. The SIM card works only with DOCOMO devices UNLOCKED with a 3G / 4G system compatible with the DOCOMO network.

    A. ◼︎Receiving messages via SMS is unlimited and free, sending up to 10 SMS messages to Japanese networks within Japan will be courtesy of NewSky, however sending over 10 SMS has a cost per message of ¥20 to Japan and ¥150 international. To avoid additional costs, we recommend using applications for sending messages such as WhatsApp, Messenger, Skype, etc .
    B. ▲ UNLIMITED CALLS PLAN: The plan has a system of unlimited and free calls to cell phones or homes, for all networks in Japanese territory. However, calls to paid numbers, such as 104/050/0570 among others, will be charged.
    C. ◆60 MINUTES FREE CALLS PLAN: The plan has 60 minutes of free calls to cell phones or home, for all operators in Japanese territory. However, calls to paid numbers, such as 104/050/0570 among others, will be charged. After using the free 60 minutes, ¥ 38 will be charged every 60 seconds.
    D. After using the contracted GB limit, the speed will be reduced to up to 128 Kbps.

IF THE CONTRACT IS CANCELED BEFORE PAYING, THERE WILL BE A FINE OF ¥ 8,000.

IF THE CONTRACT IS CANCELED AFTER PAYING 6 MONTHS, THE CUSTOMER WILL BE EXEMPT FROM THE SIM CARD CONTRACT CANCELLATION FINE.

CONTRACTING THE SERVICE WITH SMARTPHONE CAMPAIGN

IF THE CONTRACT IS CANCELED BEFORE PAYING 6 MONTHS, THERE WILL BE A FINE OF ¥ 8,000 + SMARTPHONE AMOUNT.

IF THE CONTRACT IS CANCELED AFTER 6 MONTHLY PAYMENTS PAY, THE CUSTOMER WILL BE EXEMPTED FROM THE SIM CARD CANCELLATION FINE, BUT SHALL HAVE TO PAY THE FULL SMARTPHONE AMOUNT DESCRIBED IN THE INVOICE.

IF THE CONTRACT IS CANCELED AFTER 12 MONTHS PAID, THE CUSTOMER WILL BE EXEMPT FROM THE SIM CARD FINE AND THE SMARTPHONE VALUE.

The campaign is valid for as long as the stock lasts or can be closed at any time without notice.

(if any)

◎ The discount benefit or promotion of the free device will be only who makes the 6-month contract and fulfills the minimum of 12 months of monthly payments. If there is a cancellation before this deadline, the device must be paid in full, according to the amount described in the invoice / order, in addition to the amounts of the fines termination of contract and other fees. The model  and price of the smartphone are described in your invoice.

DATE OF PAYMENT: UNTIL THE 10TH

    A. From the 11th the payment will be overdue and the service will be suspended, and a fee of ¥ 1,000 will be included in the charge.
    B. If you do not make the payment by the 20th, your contract will be understood as abandonment by the customer and will be canceled at the end of the same month. Once canceled it will not be possible to reuse the same number. Fees and fines will apply.
    C. If you want to change the form of payment from Smart pit to credit card or vice versa, the customer must contact our call center, at least 30 days in advance.
    D. Payment must be made on time and processed by our exchange so that there is no cut-off. If cut due to non-payment, the signal will be reactivated within 3 business days after confirmation and processing by our center payment.
    E. The charging fee [konbini / credit card] of ¥ 220, may be charged at any time by NewSky, without prior notice, for the readjustment of amounts. So far, this fee is being paid by NewSky.

5. IMPORTANT INFORMATION

    A. This service has MNP number portability, which allows you to change operator and remain with the same number. If you wish to transfer your line to another network, an operating fee of ¥3,300 will be charged. The deadline for numerical transfer will be up to 3 working days.
    B. If the contract is canceled, it will not be possible to reactivate the service and the telephone number will be lost (in no way will it be possible to reactivate it).
    C. It is possible to use applications with this service, however it will not be possible to perform age verification in the LINE application or similar.

6. PLAN CHANGE

    A. It is possible to increase or decrease the amount of GB within your plan. Request a change of plan with our central BETWEEN DAY 1 TO DAY 10. The change of plan will take effect from the beginning of the following month.
    B. PLAN EXCHANGE

Plan exchange fee: ¥ 2,000.

Change of plan with sim card replacement: ¥ 5,500

This fee must be paid at the time of requesting to change the plan. Payment will be made via Smart Pit or Credit Card.

7. CANCELLATION AND ABANDONMENT

MINIMUM CONTRACT 6 MONTHS

CANCELLATION FEE: ¥ ​​8,000

    A. Step 1: To cancel, the customer must contact NewSky between 1th to 10th of the current month and request the cancellation of the service. To request the cancellation of the service using a credit card payment method, the customer must contact our call center at least 30 days before the payment date.
    B. Step 2: The customer must pay the amounts owed to NewSky within the stipulated period.
    C. Step 3: Cancellation on time or after, the SIM CARD must be returned to NewSky. See details of your contract in your invoice. Cancellation prior to the expiration of the contract will be subject to a fine.
    D. After the term of the contract has been fulfilled, it may be canceled without a contract penalty.
    E. If you do not make the payment by the 20th, your contract will be understood as abandonment by the customer and will be canceled. Outstanding amounts must be paid immediately.
    F. In case of a fine, this will be charged via Smart Pit or credit card. For charging through the Smart Pit, once the charge is launched, if there is a need to launch a new charge or change the payment date, there will be a fee of ¥ 1,000 added to the amount of the fine.
    G. With the non-payment of the monthly fee and the lack of interest or lack of communication with NewSky, fines related to the clauses not fulfilled by the customer will be applied, which will be charged by our legal representative, the Libra Legal Office and / or Trade's law firm. Creditor Protection Co. Ltd., being from that moment responsible for the case and, according to the case, a case will be opened in the court of justice in the Tokyo jurisdiction. General documents and information will be used for resolution by legal means and, in addition, your name may also be registered with the CREDIT PROTECTION SERVICE in Japan and abroad. Any legal issues will be resolved with the Tokyo Court of Justice.
    H. If there is any promotion or free monthly fee, the bonus month of the promotion will NOT be counted within 6 months of the contract. The customer must pay every month of the contract, regardless of promotion. Example: If the contract is for 6 months with a free 1 month promotion, the customer MUST pay the 6 monthly installments (instead of 5), as the promotion will not enter this period.

9. CONTRACT, DATA TRAFFIC & SUSPENSION RIGHTS

    A. Please be informed that, as of January 2016, Japanese data traffic control laws have become stricter. New rules from operators or the government may occur without notice. Restrictions on the volume of data traffic may apply.

    B. We provide adequate data capacity for general use, but from the point of view of fair use and maintaining the quality of the network, the usage restriction can be applied to users who communicate in large quantities, download large files, very long videos, etc. In these cases, measures can be taken, such as interrupting communication or greatly reducing the speed of communication.

    C. Customers who consume large amounts of data need to be aware. * Will not be refunded or exchanged, etc. if suspension measures or speed restrictions are applied by the network or the government. NewSky is not responsible for signal failures in some areas.

    E. In case of delay or abandonment of a service contract, if the customer has another active service, NewSky reserves the right to be able to suspend the other service without prior notice.

    F. NewSky reserves the right to unilaterally suspend or cancel the customer's contract, if it brings losses to the company or if the company deems misuse or misconduct, such as excessive or consecutive calls for a long period, by the customer. The suspension may be made without prior notice and without compensation.

    G. In case of suspension of the service due to accidents or unscheduled maintenance in the system, fluctuations in the data network, there will be no refund for the time the service is unavailable.

    H. NewSky reserves the right, in the event of any change in the service by the operator, to pass this change on to the customer without prior notice, in compliance with the rules thus required, including price adjustments.

    I. Service with an economical data package. The speed of the Internet during use may vary due to the user's environment (such as the specifications of the terminal device) and network congestion.

    J. The collection of pendencies or debts can also be done abroad. The customer may have the name included in the SPC (credit protection service).

    K. You will be charged 14.5% interest per year on unpaid amounts and outstanding amounts with NewSky, be it late fees, cancellation penalty, or any other outstanding that the customer may have with NewSky.

    L. The SIM card MUST BE RETURNED AT THE END OF THE CONTRACT.

10. DOCUMENTS

    A. It is the customer's responsibility to keep the documents and registration data always up to date with NewSky. NewSky communicates with customers via SMS, Facebook, WhatsApp, e-mail or telephone.

11. LOSS OR THEFT

    A. In the event of loss or theft, the customer must immediately issue a report at the nearest police station or KOBAN. * This process is mandatory in case of loss or theft of a SIM CARD or SIM CARD cell phone.

12. DELIVERY OF THE SIM CARD

    A. The SIM CARD is sent to the address registered in the customer's document and only he can receive it, upon confirmation of the document at the time of delivery.
    B. The delivery person will first leave a notification. With the notification in hand, the customer should call the post office and schedule the day and time for delivery, or personally go to the post office and pick up. It is necessary to bring the notification and identification document.

13. SUPPORT

    A. NewSky does not provide support and is not responsible for software and applications used by the customer.

    B. THE MONICA TOY MOBILE FREE CALLS uses the Docomo network, but all support is exclusively offered by NewSky, where Docomo disclaims liability.

    C. Service for technical support or issues regarding late payment will only be resolved within the office hours of the responsible department: Monday to Friday from 10:00 am to 5:00 pm (closed on weekends and national holidays).
